General Terms and Conditions (GTC)
Full Proof Bakery

1. Scope
These General Terms and Conditions (GTC) apply to all contracts concluded between Full Proof Bakery., C. del Carme 16A, 07003 Palma de Mallorca, Spain (hereinafter referred to as "we" or "Full Proof Bakery") and its customers for the sale of baked goods and other products – both in our local store in Palma and via our online shop with local pickup.
2. Offer and Conclusion of Contract
a) In-store
The purchase contract is concluded when the customer selects the goods and pays at the checkout.
b) Online shop (pre-order with pickup)
The presentation of products in the online shop does not constitute a legally binding offer. By clicking the order button, you submit a binding offer to conclude a purchase contract.
The automated order confirmation by e-mail does not constitute acceptance, but only documents receipt of the order. The contract is only concluded through a separate declaration of acceptance or by making the goods available for pickup.
3. Pickup and Opening Hours
Orders placed via the online shop can be picked up at the following times:
Thursday and Friday, from 10:00 to 16:00
Pickup location: C. del Carme 16A, 07003 Palma de Mallorca, Spain
Please keep to the agreed pickup time to ensure the quality of the freshly prepared products. Orders that are not picked up – especially individually made baked goods – will be charged.
4. Prices and Payment Terms
All prices are in euros and include the statutory value-added tax.
Payment is possible:
in-store: in cash or by card
online shop: in advance or upon pickup (depending on the available payment method).
The available payment methods are shown during the ordering process.
5. No Right of Withdrawal for Food Products
As our products are freshly made and perishable, there is no right of withdrawal according to § 312g para. 2 no. 2 BGB.
Orders – especially in the online shop – are therefore binding.
6. Warranty and Complaints
Statutory warranty rights apply.
Complaints about obvious defects must be made immediately upon pickup.
In the case of justified defects, we will either provide a replacement or refund the purchase price at our discretion.
7. Allergens and Product Information
Information on allergens and ingredients is available on-site and in the online shop for each product or upon request. Please inform yourself about potential intolerances before purchase.
8. Retention of Title
The goods remain our property until full payment has been made.
9. Liability
We are fully liable for intent, gross negligence, and injury to life, body, or health.
For slight negligence, we are only liable for breaches of essential contractual obligations (cardinal obligations) and only for typical and foreseeable damage.
10. Data Protection
Personal data is processed exclusively for order processing and communication.
A complete GDPR-compliant privacy policy is available on our website. It includes information on: type and purpose of data collection, tools used (e.g. payment services, cookies), retention periods, disclosure to third parties, and your data subject rights.
11. Governing Law
Spanish law applies, taking into account mandatory consumer protection provisions of the buyer's country of residence, particularly for consumers residing in Germany.
